Terms of Use

1. Overview of the service

These Terms of Use ("Terms") govern the use of the Pumpfy mobile application and related services ("the Service"), operated by Buğra Göksu ("the Company", "we"). By using the Service you accept these Terms, our Privacy Policy and, where applicable, the subscription terms.

If you do not accept these Terms, do not use the app.

2. Definitions

  • "App": The Pumpfy mobile application offered on iOS and Android.
  • "User", "you": The individual who downloads and/or uses the app.
  • "Content": Training programs, nutrition plans, calorie analyses and other information produced by the app.
  • "User Content": Photos, data and records the user uploads or creates in the app.

3. Account and access

  • You can use the app anonymously with its basic features. Full functionality requires signing in with your Apple or Google account.
  • You are responsible for the security of your account and for all activity carried out through it.
  • If you detect unauthorised access to your account, report it immediately to info@getpumpfy.app.
  • Age limit: You must be at least 13 years old to use the app. Users under 18 must use it with the consent of a parent or legal guardian.

4. Subscription, payment and cancellation

4.1 Free trial

Pumpfy may offer new users a free trial. Where one is offered, its length and the price that applies afterwards are shown on the purchase screen. If you do not cancel before the trial ends, the plan you selected starts automatically and your payment method is charged.

4.2 Plans

  • Monthly subscription: Renews automatically every month.
  • Annual subscription: Renews automatically every year.
  • Current prices are shown on the in-app purchase screen and on the App Store / Google Play.

4.3 Automatic renewal

Unless cancelled at least 24 hours before the current period ends, subscriptions renew automatically at the same plan and price. The renewal fee is charged within the 24 hours before the period ends.

4.4 Cancellation

  • iOS:Settings > your Apple ID > Subscriptions > Pumpfy > Cancel Subscription.
  • Android:Google Play > Payments and subscriptions > Subscriptions > Pumpfy > Cancel.
  • After cancelling, you keep access to all premium features until the end of the current period.
  • You can also request cancellation from inside the app or by emailing us.

4.5 Refunds

Refund requests are subject to Apple's or Google's refund policies. Because payments are processed through the App Store or Google Play, refund requests must be made directly through that platform.

5. AI content and health disclaimer

IMPORTANT: Read the following carefully.

  • The training programs, nutrition plans and calorie analyses Pumpfy provides are for informational purposes only.
  • This content does not replace professional medical, dietary or physiotherapy services and is not intended as treatment.
  • Calorie and macronutrient calculations produced by AI are estimates; no guarantee of complete accuracy is given.
  • If you have any health condition, chronic illness, allergy or specific medical situation, consult your doctor before using the app.
  • If you are pregnant, breastfeeding or under a strict dietary restriction, consult a health professional before using the app.
  • The Company cannot be held responsible for health problems arising from following the app's recommendations.

6. User content and licence

  • Intellectual property rights in the content you upload (photos, data) remain yours.
  • By uploading content you grant a limited, royalty-free, irrevocable licence to process that content for the purpose of delivering the service (for example AI analysis).
  • You represent and warrant that the content you upload is lawful and does not infringe third-party rights.

7. Intellectual property

All intellectual property rights in the Pumpfy app, brand, logo, design, software code and generated Content belong to the Company or are used under licence. These Terms grant the User no intellectual property rights beyond the right to use the Service for personal, non-commercial purposes.

8. Unacceptable use

The following are strictly prohibited:

  • Reverse engineering, decompiling or disassembling the app's source code.
  • Unauthorised API access, automated requests (bots, scrapers) or any use incompatible with the purpose of the service.
  • Attempting to access other users' data or to take over accounts.
  • Using the app for unlawful purposes or in a way that infringes third-party rights.
  • Uploading or transmitting viruses, malware or harmful code.
  • Actions that place excessive load on the server or network infrastructure.

Accounts that break these rules may be suspended without notice or closed permanently.

9. Suspension and termination

  • If you breach these Terms we may suspend or terminate your account without prior notice.
  • You can close your account at any time through Delete Account in the app or by writing to info@getpumpfy.app.
  • If you close your account, the service continues for the remainder of your active subscription period and access ends when that period is over.
  • Following a deletion request, your personal data is deleted within 30 days under our Privacy Policy.

10. Limitation of liability

  • The app is provided "as is" and "as available".
  • No express or implied warranty is given that the service will be uninterrupted, error-free or secure.
  • The Company is not liable for indirect, incidental, special or punitive damages (including lost profit or lost data) arising from use or inability to use the app.
  • In any case, the Company's total liability cannot exceed the subscription fees paid by the user in the previous 12 months.
  • The app may be temporarily unavailable for maintenance, updates or technical reasons; such cases do not create liability.

11. Indemnity

You agree to hold the Company harmless from and indemnify it against any claim, action, damage or cost (including legal fees) brought by third parties as a result of your breach of these Terms or unauthorised use of the app.

12. Third-party services

The app uses third-party services (Firebase, Google Gemini AI, RevenueCat, Apple/Google payment systems). Those services have their own terms and privacy policies. The Company accepts no responsibility for their operation, availability or security.

13. App store terms

In addition to these Terms:

  • iOS users are subject to Apple's Licensed Application End User License Agreement (EULA).
  • Android users are subject to the Google Play terms of service.
  • Apple and Google are third-party beneficiaries of these Terms and may enforce them on their own behalf.
  • Maintenance and support of the app are the sole responsibility of the Company; Apple and Google have no maintenance or support obligation.
  • In case of claims that the app infringes third-party intellectual property rights, the Company is responsible, not Apple or Google.

14. Force majeure

The Company cannot be held responsible for disruption or suspension of the service caused by natural disasters, war, terrorism, epidemics, government decisions, internet infrastructure failures, cyber attacks or similar events beyond our control.

15. Changes to these Terms

We reserve the right to update these Terms from time to time. For significant changes you are notified in the app and/or by email. Continuing to use the app after changes are published means you accept the updated Terms.

16. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions stay in full force.

17. Governing law and jurisdiction

These Terms are governed by the laws of the Republic of Türkiye. The courts and enforcement offices of Istanbul have exclusive jurisdiction over any dispute arising out of or connected with these Terms.
